Starlink Aviation Privacy Notice

Compliance with the Act Respecting the Protection of Personal Information in the Private Sector (Quebec, CQLR c P-39.1)

Please do not send confidential or sensitive information (social insurance number, financial, medical, passport, driver’s license, etc.) by email or through our forms, unless such transmission has been explicitly requested by Starlink Aviation.

Any information sent without explicit request may be subject to unauthorized access. In such cases, Starlink Aviation shall not be held liable for disclosure resulting from unsolicited transmission.

1. Purpose, scope and users

This privacy notice describes the policies and procedures regarding the collection, use, disclosure, retention, and destruction of personal information when using the Service, as well as your rights and how the law protects you. At the time of collection, we inform you: (1) of the purposes for which the information is collected, (2) of the means by which it is collected, (3) of your rights of access and rectification, and (4) of your right to withdraw consent. We collect only the information necessary to achieve the identified purposes. Consent is explicit, free, informed, and given for specific purposes. (Act P-39.1, s. 3.1, s. 5, s. 8, s. 14)

2. Collection and use of personal information

We collect only the personal information necessary for the purposes identified and communicated at the time of collection:

  • Identification information (name, email address, phone number, etc.)
  • Usage data (described below)
  • Cookies and other tracking technologies (non-essential disabled by default) (Act P-39.1, s. 5, s. 8)

2.1.1 Usage data

Collected automatically when using the Service: IP address, browser type and version, pages visited, date and time, time spent, device identifiers, diagnostic data. For mobile access: device type, unique ID, IP address, operating system, browser, and diagnostic data. (Act P-39.1, s. 5)

2.1.2 Cookies and tracking technologies

By default, only necessary cookies are active. Non-essential cookies (analytics, marketing, etc.) require explicit, free, and informed consent. Persistent cookies remain after the browser is closed; session cookies are deleted upon closing. (Act P-39.1, s. 8.1)

2.2 Methods of collection

Directly from you (registration, order, survey, site usage, contracts and quotes). Indirectly from third parties only with your consent or when permitted by law. (Act P-39.1, s. 8, s. 12)

3. Use

Information used only for the purposes identified: processing orders, account management, promotional communications (with consent). (Act P-39.1, s. 5, s. 12)

4. Retention and duration

Location: Montreal, Quebec, Canada. Security: physical, logical, and organizational controls. Retention: 7 years for contractual data, 3 years for marketing data after last contact. Secure destruction: permanent deletion and physical destruction of media. (Act P-39.1, s. 10)

5. Marketing

We send marketing communications only if you have given explicit, free, and informed consent for this purpose. You may withdraw this consent at any time through the unsubscribe link in each message or by contacting us. No personal information is shared with partners for marketing purposes without your prior consent. (Act P-39.1, s. 14, s. 30)

6. Transfer outside Quebec

Any transfer of personal information outside Quebec is subject to a Privacy Impact Assessment (PIA) and will only take place if the destination jurisdiction provides adequate protection equivalent to that under Quebec law. A written agreement guarantees this protection. (Act P-39.1, s. 17)

7. Disclosure authorized by law

We may disclose personal information without consent in cases provided for by law, including: business transaction, legal obligation, protection of life or safety, protection of company rights, fraud prevention. Such disclosures are recorded in our incident register. (Act P-39.1, s. 12, s. 18, s. 18.1, s. 18.4)

8. Security of information

We apply physical, logical, and organizational measures proportionate to the sensitivity of the information to protect it from loss, theft, unauthorized access, disclosure, reproduction, use, modification, or destruction. (Act P-39.1, s. 10)

9. Legal basis and rights

We process personal information on one or more legal bases provided by law: consent, contractual necessity, legal obligation, vital interests, public interest, legitimate interests. You have the right: access, rectification, deletion, objection, portability, withdrawal of consent, cessation of dissemination or de-indexing. Requests are processed within the statutory time limits after identity verification. (Act P-39.1, s. 27, s. 28, s. 28.1, ss. 30 to 32)

10. Links to other sites

Our service may contain links to third-party sites. We are not responsible for their privacy practices and recommend reviewing their privacy notices. (Act P-39.1, s. 8)

11. Changes to the notice

We update this notice when required by law or when our practices change. The updated version is posted on our website with a clear notice of changes and the update date. (Act P-39.1, s. 8)
